and visitors. This includes training its police and all municipal
employees as well as making sure that the streets and public areas

for an innocent bystander shot by an off-duty police officer.

Landlords and building owners must provide a safe environment for

$12 Million in Medical Malpractice Case
A third-year resident failed to seek senior doctors' advice and
delayed the cesarean section birth even after pH testing indicated
the infant was near death and suffering from severe hypoxia. The
infant suffered meconium aspiration syndrome. She was placed on
a heart-lung machine, however, she died due to an infection 12 days
later. The jury deliberated for two hours before returning with
the verdict of $12 million for conscious pain and suffering as well
as an additional $83,000 for wrongful death.
$5 Million in Medical Malpractice
Case
A 29-year-old lawyer went to a Manhattan Hospital for treatment
of low sodium. She was given too much sodium to correct her condition,
known as hyponatremia. Physicians failed to monitor the procedure
and her reaction properly. As a result, she suffered permanent brain
damage and double vision. In addition, she is prone to falling and
injuring herself. WKW obtained a $5 million settlement in 2003.
$1.7 Million in Medical Malpractice
Case
The delayed and traumatic vaginal delivery of an infant resulted
in the child suffering from Erb's palsy. At trial, a $1.7 million
verdict was obtained.

$1.5 Million in Auto Death Case
A head-on collision after an auto crossed over to the opposite lane
killed a 45-year-old business owner with a family of five. At trial,
the estate of defendant conceded liability, and the court awarded
$1.5 million to plaintiff's estate.
$1.05 Million in Auto Death Case
This case involved the hit-and-run death of a 58-year-old woman
who was hit by a bus while trying to cross the street. The bus driver
claimed he did not know he had hit anyone although a witness on
the bus testified that she had seen the woman and felt the bump
as the bus went over her. A verdict of $1.05 million was obtained.
$1 Million in Auto Accident Case
A 66-year-old woman was struck while standing on the sidewalk near
the curb. She suffered a fracture of the medial and lateral tibial
plateau. Evidence indicated that the vehicle which struck her had
just been cut off by a taxi cab. Neither of the responsible parties
were ever located and did not appear at trial.

$3.86 Million in Partial Collapse of Building
A worker sustained multiple fractures of vertebrae and tibia/fibula
when the parapet of wall falls. He suffered scarring, deforming
disfigurement, psychological and neurological damages and multiple
surgeries were required. Defendants conceded liability at trial
and upon hearing medical and economic expert testimony, court awarded
$3.86 million.
Construction Worker Injured By
Falling Pipe
48-year-old Hamda Mohammed was working in the 6th Floor window from
of a Brooklyn senior citizens home when he heard a clanking noise.
A hot pipe being lowered from the roof was suddenly dropped and
hit the back of his neck. Mr. Hamda suffered a burn and a c-5 herniated
disk. After opening statements, Paul Weitz settled the case against
the owner of the building, the housing development fund and the
roofing company for $850,000.
Apprentice Elevator Mechanic Struck By Falling Weight
Jean-Paul Lara, a 24-year-old apprentice elevator mechanic was attempting
to loosen a bolt in an elevator shaft, one in a bank of three elevators.
A counter weight fell and struck him in the head. Building management
had been requested to shut down the other elevators and failed to
do so. Mr. Lara suffered multiple facial fractures and underwent
three surgeries. Paul Weitz settled Mr. Lara's case for $1.35 million.
$7.4 Million in Labor Case
A carpenter was told to climb a partially demolished scaffold. When
a weakened railing collapsed, he fell and suffered wrist and vertebrae
fractures and head injuries. A $7.4 million verdict was obtained.

$700,000 in Lead Poisoning Case
From October 1992 to April 1994 (before his children were found
to have elevated blood lead levels) the father of seven-year and
three-year-old daughters made numerous complaints regarding peeling
paint in their apartment. However, no action was taken. A ten-day
trial concluded with a verdict of $700,000 on behalf of the sisters.
Off-duty Police Officer Shoots
Bystander in Car
While a customer at a Brooklyn beauty parlor, an off-duty NYPD officer
gave chase to robbery suspects. He alleged that the suspects fired
a gun. He claimed to have returned fire and hit the innocent driver
of a car stopped at a light. Keith McKinley was a 43-year-old bank
clerk when he was shot. He suffered a serious head wound. Keith
Kleinick obtained a $1.5 million settlement for Mr. McKinley who
is now on permanent disability.

$1.5 Million in Premises Liability Case
A 79-year-old woman suffered four pelvic fractures and was bedridden
for the remaining year of her life due to a fall caused by a selector
malfunction which caused the elevator at her daughter's residence
to stop in an unleveled position. A three-week trial concluded with
a $1.5 million verdict.
College Student Exposed to Toxic
Matter
A 21-year-old design school student was in an area of the school
that was improperly ventilated. She was exposed to toxic chemicals
including Benzine and developed aplastic amenia. Andrew Weitz obtained
a $900,000 settlement for her.
